The Protection of Personal Information Act 4 OF 2013 (“POPIA” or “the Act”) is in operation and we are required to comply. The Act regulates how we handle your personal information while we conduct our business. Personal Information will be understood in accordance with the definition provided in the Protection of Personal Information Act 4 of 2013 (“the Act”) and in accordance with the definition of Personal Data in Article 4(1) of the General Data Protection Regulation GDPR (EU) 2016/679
The application of the Act is intended to balance 2 competing interests, which are as follows: –
- Your constitutional right to privacy (which requires your personal information to be protected); and
- The needs of society to have access to and to use your personal information for legitimate purposes (for example, to enable us to effectively transact with you).
The Act obliges us to inform you of our process, and that is the main purpose of this correspondence. If you wish to have greater insight into the way in which we implement the POPI Act, you may ask for a copy of our company’s PAIA/POPIA Manual.
THE COLLECTION AND PROCESSING OF PERSONAL INFORMATION
- We will collect the majority of your personal information from yourself. Please cooperate with us when we do so.
- We will be collecting your personal information to enable us to fulfil the transaction that you require from us. This might be the receiving purchase orders, supplying of merchandise and transporting of goods.
- You have a choice as to whether you wish to provide us with your personal information. However, please note that if you fail to provide the information we ask for, we will not be able to transact properly with you.
- We will not pass your personal information to any third party without your consent. We, therefore remain fully accountable for the information you provide us with and it is our duty to ensure that the personal information is kept safely, responsibly and within the ambit of the law.
- You can rest assured that unless we are legally obliged to share your personal information, we will only share so much of your personal information as is needed by the authority that requires it, and we will only do so when it is necessary for us. In addition, all of our staff are bound by confidential clauses in their letters of employment.
- If there is an international component to the work which we are doing for you, and if we are required to share your personal information with an overseas recipient, you are entitled to ask us how your personal information will be protected in this foreign country, and we will endeavor to assist you.
- You have the right to access your personal information and the right to correct any errors relating to the information that we have on record by contacting the Information Officer, namely Rhulani Chauke at this email address: rhulani@phaphatani.com
- In addition, you have the right to object to us continuing to process your personal information. Please note that if you do exercise this right, we will not be able to effectively transact and provide the service which you require.
- We are obliged by law to retain our records for a period of time after we have completed our work. During this period, your personal information will also remain protected. After this period has expired, your personal information will be destroyed in a way that de-identifies you.
THE SECURITY OF OUR SYSTEMS:
- We have put reasonable safety measures to safeguard your data which is also entrenched in our digital infrastructure to keep your personal information secure. We are using anti-virus malware security, password vault, Acronis Backup with 30 days of retention, Data Encryption, multi-factor authentication feature and secured cloud-based server that comply with industry standards and the General Data Protection Regulator (GDPR) falling within the European Union and complying with standards of the European Union.
Should you have any issues with the way in which we are processing your personal information, you are entitled to lodge a complaint with the Information Regulator, whose contact details are:
